1. About these terms

These Terms of Service (the "Terms") govern your use of the Stahlgard website (stahlgard.com.au and any related subdomains) and any purchase you make from us. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

"Stahlgard", "we", "us" and "our" refer to the operator of this store. "You" refers to the person accessing the site or placing an order.

2. Eligibility

You must be at least 18 years of age, or have permission from a parent or guardian, to place an order. By submitting an order you confirm you meet this requirement and that the information you provide is accurate.

3. Products

We make reasonable efforts to display our products accurately, including images, dimensions and specifications. However, slight variations in colour or finish may occur depending on your device. We reserve the right to update product information, change pricing or discontinue products at any time without notice.

4. Orders and acceptance

When you place an order you are making an offer to purchase. Your order is not confirmed until we accept it and send you an order confirmation email. We may decline or cancel an order at our discretion, including where the product is unavailable, pricing is incorrect, or we suspect fraudulent activity. If we cancel an order you have already paid for, we will refund you in full.

5. Pricing and payment

All prices are in Australian dollars (AUD) and include GST where applicable. Shipping is calculated separately at checkout. We accept the payment methods displayed at checkout. You authorise us to charge the payment method you provide for the total order amount.

6. Shipping, returns and refunds

Shipping and delivery information is set out in our Shipping & Returns page. Returns and refunds are governed by our Refund Policy, which forms part of these Terms.

7. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits or excludes your rights under the ACL.

8. Lifetime guarantee

The Stoplock Pro Elite is backed by a manufacturer's lifetime guarantee against defects in materials and workmanship. This guarantee operates alongside, and does not replace, your rights under the ACL.

9. Intellectual property

All content on the Stahlgard website, including logos, product photography, written content, design and code, is owned by Stahlgard or used under licence. You may not copy, reproduce, republish, modify or distribute any of this content without our prior written permission, except for personal, non-commercial use.

10. User conduct

You agree not to use the site in any way that is unlawful, infringes our rights or the rights of others, or that could damage, disable or impair the site. You must not attempt to gain unauthorised access to any part of the site or its underlying systems.

11. Third-party links

The site may contain links to third-party websites. We do not control these sites and are not responsible for their content, practices or policies. Following any external link is at your own risk.

12. Limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, Stahlgard's total liability to you for any claim arising out of these Terms or your use of the site is limited to the amount you paid for the relevant order. We are not liable for indirect, consequential or incidental loss.

13. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

14. Changes to these terms

We may update these Terms from time to time. The version in effect at the time you place an order applies to that order. We will post any updates on this page with a revised "last updated" date.

15. Governing law

These Terms are governed by the laws of the State of Victoria, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of that State for any dispute arising from these Terms or your use of the site.
